By accessing Herkysurveys.com and purchasing land records, you agree to be legally bound by these terms. If you do not agree, you are prohibited from using this site or purchasing any files.

2. Use License & No-Adverse Use

Permission is granted to download purchased survey records for professional or personal reference. However, as a condition of purchase, you agree that:

• You will not use any record purchased from this site as evidence or grounds for a legal claim, lawsuit, or demand against Herky Surveys, its owners, or employees.
• The records are provided for informational purposes only and do not constitute legal advice or a modern land survey certification from us.

3. Covenant Not to Sue

By purchasing a record, you hereby waive, release, and forever discharge Herky Surveys from any and all claims, causes of action, or liabilities arising from the data contained within the records. You agree that you will not initiate, maintain, or participate in any lawsuit or legal proceeding against Herky Surveys regarding the accuracy, validity, or interpretation of the files provided.

4. Nature of Records ("As-Is")

Herky Surveys acts as a digital repository for historical documents. We are not the original surveyors. We make no warranties, expressed or implied, regarding the accuracy of the boundary lines, measurements, or data within these records. All files are sold "As-Is."

5. Payment and Refund Policy

Due to the digital nature of our products, all sales are final. No refunds will be issued once the file has been delivered to your email address.

6. Indemnification

You agree to indemnify and hold harmless Herky Surveys from any costs, legal fees, or damages resulting from your use of the purchased records in a manner that violates these terms or infringes on the rights of any third party.
